[PM Modi Degree Row] Gujarat High Court Denies Stay in Defamation Case Against Arvind Kejriwal and Sanjay Singh; Notice issued to Gujarat University

The case stems from a defamation complaint filed by Gujarat University against Kejriwal and Singh, accusing them of tarnishing the university's reputation

Today, the Gujarat High Court refused to stay the proceedings in the defamation case against Delhi Chief Minister Arvind Kejriwal and Aam Aadmi Party's Rajya Sabha MP Sanjay Singh, related to Prime Minister Narendra Modi's academic degree. The case is currently pending in an Ahmedabad court.

In a bid to challenge a defamation complaint against them, Delhi Chief Minister Arvind Kejriwal and AAP's Rajya Sabha MP Sanjay Singh have sought the quashing of a summons issued by an Ahmedabad Magistrate Court. The two AAP leaders are also contesting the sessions court order that upheld the summons.

This case stems from a defamation complaint filed by Gujarat University against Kejriwal and Singh, accusing them of tarnishing the university's reputation. The university sued the politicians for making derogatory statements about their refusal to disclose Prime Minister Modi's degree.

The single judge bench of Justice JC Doshi declined to provide interim relief by halting the case proceedings and issued notice to Gujarat University in the revision plea filed by Kejriwal and Singh.

The hearing has been adjourned to November 3, 2023. 

On September 14, 2023, Additional Sessions Judge J M Brahmbhatt dismissed the two criminal revision applications filed by Arvind Kejriwal and Sanjay Singh against the summons issued to them by the magistrate court in the defamation case. 

Following the university's complaint, a Magistrate's court had issued summons to the two politicians in April this year.

On April 17, Additional Chief Metropolitan Magistrate Jayeshbhai Chovatiya ruled that Kejriwal and Sanjay Singh's statements were prima facie defamatory.
