Porsche Case: Aunt Of Juvenile Moves Bombay High Court Seeking Juvenile's Release

The paternal aunt of the 17-year-old juvenile accused has moved the Bombay High Court seeking the release of the juvenile.

In her petition, the aunt of the 17-year-old has stated that the juvenile has been unlawfully detained by the Juvenile Justice Board.

The petition was heard by a division bench of Justice Bharathi Dangre and Justice Manjusha Deshpande on Friday.

Chief Public Prosecutor Hiten Venegoankar opposed the petition and submitted that the juvenile was remanded to the observation home by way of a judicial order.

Senior Advocate Aabad Ponda, appearing for the aunt of the juvenile, sought immediate release and also sought time to amend the petition to annex the order.

The division bench denied interim relief but allowed the petitioner to amend the petition and scheduled it for hearing on 20th June.

The 17-year-old, son of a builder in Pune, was booked by the Pune Police under sections 304A, 279, 337, and 338 of the Indian Penal Code after his Porsche car hit a motorcycle, resulting in the death of two people.

The juvenile was earlier granted bail by the Juvenile Justice Board but was later remanded to the observation home.

The petition states that the special judge was swayed by media pressure and remanded the juvenile to an observation home after granting bail.

"As stated above, even the Special Judge seemed to have swayed away by the pressure of media reports. The Petitioner by no means is commenting upon the integrity and the substantiveness of a Judicial Of- ficer, but is only trying to highlight that in the present matter, the media is playing a huge part and one can easily see how a member of the Juvenile Justice Board is hounded. The intervention of this Hon'ble Court in the present case is essential to protect the spirit of justice," the plea reads.
