Punjab and Haryana High Court dismisses plea by gangster's mother demanding bullet proof jacket for son inside and outside jail

The Punjab and Haryana High Court on Monday dismissed a plea filed by Gangster Jaggu Bhagwanpuria's mother seeking a direction to the State of Punjab to provide a bullet proof jacket to her son both inside and outside the jail as and when he is to be produced in Courts or is taken out on production warrants.

The plea filed by Harjit Kaur, Bhagwanpuria's mother, alleged that there was grave threat to his life at the hands of his enemies/gangsters.

A single judge bench of Justice Manjari Nehru Kaul was informed that Bhagwanpuria was lodged in Central Jail, Tihar, New Delhi.

Court noted that Advocate Mandeep Kaushik, appearing for Kaur, failed to bring to the court's notice any cogent material qua the alleged threat perception to her son.

Furthermore, R.S. Rai, Senior Advocate, assisted by Gaurav Garg Dhuriwala, Senior DAG, Punjab, Luvinder Sofat, AAG, Punjab and Pratham Sethi, Advocate, appeared on behalf of the State and raised an objection qua the maintainability of the instant petition as Bhagwanpuria was lodged in Tihar Jail, New Delhi which was outside the territorial jurisdiction of the High Court.

Court, agreeing with such submission on behalf of the state, refrained from passing any directions as prayed for, since Kaur's son was lodged in a jail beyond its jurisdiction.
