SCBA members call for removal of President Adish Aggarwala over letter to CJI against farmers protest

Synopsis

The executive members of SCBA have also disagreed and dissociated themselves with their President's letter to CJI over farmers protest

Members of the Supreme Court Bar Association (SCBA) have called upon the Executive Committee to have an emergent body meeting so as to remove Adish C. Aggarwala, the President of SCBA.

This comes in backdrop of the letter written by Aggarwala to the Chief Justice Of India seeking suo moto action against the erring farmers who are protesting.

Aggarwala is said to have acted without any authority and capacity in the matter. Notably, the letter was written on the SCBA's letterhead in blatant misuse of the President's position.

Furthermore, 13 out of 21 members of the SCBA's Executive Committee have clarified that the SCBA President wrote the letter unilaterally without any consultation with the members of the Executive Committee.

SCBA President in his in his letter to the CJI, stated that "inspite of the best efforts of the Government of India to protect the interest of the farmers, some farmers are en route to Delhi from Uttar Pradesh, Haryana, and Punjab and are gearing up for a large-scale protest in the national capital on February 13".

This is definitely not the first instance where a call has been made to remove an SCBA President.

In 2020, Advocate Ashok Arora, the then Secretary of SCBA had called for a general meeting with one of the stated points of agenda being the removal of Senior Advocate Dushyant Dave from the President's post.

After Dave had called retired Justice Arun Mishra commending Prime Minister Narendra Modi as a "versatile genius" as a "illegal, improper and unfortunate" move, a notice was issued by the SCBA secretary to consider removal of Dave from the primary membership of the SCBA.
