Supreme Court allows Judicial Officer suffering from Bipolar Affective Disorder to discharge his duties

The Supreme Court has recently allowed a plea by a Judicial Officer, namely Bhavya Nain, who is said to be suffering from Bipolar Affective Disorder, to discharge his duties.

A Medical Board was constituted consisting of Dr. R.K. Chadda, Prof. & Head, Deptt. Of Psychiatry as a Chairperson with three Members and a Member Secretary at AIIMS to examine the officer's condition.

After an interaction with Nain and examining his medical records, the Board opined that Nain suffers from Bipolar Affective Disorder but has been in remission (asymptomatic) since August, 2018.

The Board had also spoken in person to the doctors who had earlier issued the Disability Certificate.

"At present he is stated not to have any disability and there is nothing to indicate that he will not be able to discharge his responsibilities to the post of Judicial Officer for which he has been selected. He has, however, been advised to continue his regular treatment and follow-up with his treating Psychiatrist", noted the Court.

In view of the aforesaid medical report, a bench of Justices SK Kaul and MM Sundresh opined that Nain, petitioner before the High Court, was entitled to succeed.
