Supreme Court asks Union Government to fill vacancies at Central Government Industrial Tribunals by August 31

Synopsis

On the last date of hearing, the supreme court was informed that as many as nine out of twenty two benches of the Central Government Industrial Tribunals were vacant.

The Supreme Court of India has directed the Union government to fill in the vacancies at the Central Government Industrial Tribunal by August 31, 2023.

On July 5, the top court had issued notice in a plea filed by Labour Law Association which states that as many as nine out of twenty two benches of the Central Government Industrial Tribunals were vacant and three more would fall vacant in 2023.

When the matter was taken up on Monday (July 17), the bench noted that a Search-cum-Selection Committee chaired by Justice Abhay S Oka was constituted by a notification issued by the Ministry of Labour and Employment on 6 March 2023, which had carried out the selection process and had made nine recommendations on 26 and 27 June 2023.

The Union government has carried out a further process for effectuating appointments in terms of the recommendations made by the SCSC, the bench recorded.

Additionally, Balbir Singh, Additional Solicitor General, informed a CJI DY Chandrachud led bench that the process would be completed within a period of four weeks.

Hearing this, a bench also comprising Justices PS Narasimha and Manoj Misra ordered,

"We direct the Union government to complete the process and notify the appointments on or before 31 August 2023. The petition is accordingly disposed of, at this stage."

The petitioner further requested the Court to pass an order stating that any officers of the Tribunal who were retiring in July would not demit office, which the bench refused to allow.

Court has further granted liberty to the petitioners to approach them in case of any difficulty.
