Supreme Court declines to cancel Congress MLA Sukhpal Khaira's bail in NDPS case

Synopsis

Though MLA Khaira was granted bail by the high court recently, he has been arrested in a fresh case relating to charges of criminal intimidation

The Supreme Court today declined to interfere with the bail granted to Congress MLA Sukhpal Khaira in a case registered in 2015 under the Narcotics Drugs and Psychotropic Substances Act (NDPS Act).

Punjab government had approached the top court challenging the bail order passed by the High Court on January 4, 2024.

A division bench of Justices Bela M Trivedi and KV Viswanathan rejected the appeal filed by State of Punjab asking it to file appropriate applications before the High Court.

Senior Advocate Siddharth Luthra, appearing for the Punjab government, was told that though the allegations were serious, in the facts and circumstances of the case, court was not inclined to interfere with the high court order.

Court further asked the Punjab government as to why there was a chargesheet against Khaira in the first instance, after the case was concluded. 

A Single-judge bench of the High Court comprising Justice Anoop Chitkara had recorded a prima facie satisfaction that Khaira was not guilty of the allegations made against him.

The drugs case was registered in March 2015 at Jalalabad in Fazilka. Nine people, including Gurdev Singh, a close aide of Khair, were booked in connection with the case and later convicted.

In the instant case, the police had seized two kg of heroin, 24 gold biscuits, a country-made pistol, a .315-bore pistol and two Pakistani SIM cards.
