Supreme Court Declines To Halt Rajasthan Cricket Association Election Polling; Result Declaration Stayed

The Supreme Court on Tuesday directed that the results of the Rajasthan Cricket Association (RCA) elections, scheduled to be held on September 29, shall not be declared and must instead be kept in a sealed cover pending further adjudication. The Court, however, declined to stay the election process itself.

A Bench comprising Chief Justice Surya Kant, Justice Joymalya Bagchi and Justice V. Mohana passed the order while hearing a plea challenging aspects of the RCA electoral process.

"Having regard to the issues raised by the petitioner, especially of women's representation in the Rajasthan Cricket Association, we direct that the election, which is scheduled to take place today, will take place. However, the result be not declared," the bench said today.

The Court allowed the polling to proceed as scheduled at 11:30 am but directed the Returning Officer to preserve the outcome in a sealed cover. Thus, while voting will take place, the elected office-bearers cannot be formally declared until further orders.

Court heard a petition filed by a former woman cricketer, Megha Gaur, who has raised concerns regarding the composition of the RCA electoral body. The plea points out that there is neither a woman voter nor a woman candidate in the election.

The dispute comes amid a series of legal proceedings concerning the constitution of the RCA's electoral college and the eligibility of various district cricket associations to participate in the election.

Rajasthan High Court had earlier dealt with disputes concerning voting rights of district cricket bodies. On September 10, the High Court permitted a faction of the Sawai Madhopur District Cricket Association to participate provisionally in the RCA's September 29 election, subject to the final outcome of the pending proceedings.

Separately, the Rajasthan High Court on September 23 declined interim relief sought by the Karauli District Cricket Association, which had sought permission to vote in the RCA elections or, alternatively, a stay on declaration of the election results. The Court observed that the petitioners could approach the RCA Returning Officer or pursue other legal remedies.

The RCA election schedule had provided for polling on September 29, with counting and declaration of results contemplated thereafter if voting was required.

Supreme Court's order from today therefore allows the electoral exercise to continue while keeping the outcome in abeyance. The results will remain sealed until the Court considers the issues raised in the pending proceedings.
