Supreme Court directs ASG to serve statements recorded in Trinamool Leader SK Supian arrest case

The Supreme Court has ordered the Union to provide copies of recorded statements to the petitioners in the matter pertaining to Trinamool Congress leader SK Supian @ Sheikh Sufiyan who has been accused of killing a Bhartiya Janta Party Supporter Debabrata Maiti at Chillogram in Nandigram after the results of state legislative polls were declared. 

The plea has been filed challenging the Calcutta High Court order dismissing Sufian's anticipatory bail application in the post-poll violence case. In the last date of hearing a division bench of Justice L Nageswara Rao and Justice BR Gavai granted interim protection to Supian stating that the Court can hear the matter only after the statements are placed on record.

Sufian was questioned by CBI detectives in connection with post-poll violence in Nandigram shortly after the polls. Sufian applied for anticipatory bail in the Calcutta High Court to avoid arrest. A division bench of Justice Sabyasachi Bhattacharya and Justice Rabindranath Samanta had earlier directed that the Central Bureau of Investigation (CBI) would not be able to arrest Sheikh Sufian till November 

On Monday, Senior Advocate Kapil Sibal appearing on behalf of the Supian submitted that the first charge-sheet did not name Supian as an accused. Sibal submitted that the charges are based on statements made under Sec.164 CrPC, however, these statements did not mention Supian's name. 

The Court noted that statements made under S.164 by Manoj Kumar Behra and Sulekha on November 11 and 18 have not been provided to petitioner and asked ASG Aman Lekhi to provide relevant documents to the petitioner.


Court: Statements recorded on November 11 and 18 have not been given to them. ASG Lekhi: The second charge-sheet filed on January 6 have relied on these statements. Sibal: I have not been provided these statements.

The matter is set to be heard on Thursday.
