Supreme Court was told today that the trial court had also recently dismissed Surjewala's application seeking some origin records relating to the crime
The Supreme Court today stayed the execution of a non-bailable warrant issued against Congress leader Randeep Surjewala in a 2000 case.
A bench of CJI DY Chandrachud, Justice JB Pardiwala and Justice Manoj Misra has granted Surjewala liberty to move the trial court for cancellation of the warrant within 4 weeks.
Two days back, Varanasi court's special judge (MP-MLA) Avanish Gautam has issued non-bailable warrant against the national spokesperson of Congress, ordering him to be produced before the court on November 21.
Today, Senior Advocate AM Singhvi mentioned Surjewala's plea before the supreme court saying that the incident in question has occurred 22 years back.
When CJI Chandrachud questioned Singhvi about approaching the Allahabad High Court first, he said, "I did, but no orders were passed..FIR is from 2000 over a political agitation did in 2000..he is summoned in August 2022..".
Singhvi then pressed for some breathing time for his client.
"A grievance is made that High Court did not entertain petition seeking quashing of NBW. Petitioner is granted liberty to move trial court for cancellation of NBW within 4 weeks..the warrant shall not be executed in the meantime for a period of 5 weeks", the bench ordered accordingly.
