Supreme Court To Hear Manoj Tiwari & Vijender Gupta’s Plea To Quash Summons On Sisodia’s Defamation Complaint On August 25

The Supreme Court today adjourned the appeal filed by BJP leaders Manoj Tiwari and Vijender Gupta challenging the Delhi High Court’s verdict which had upheld the November 28, 2019 summoning order passed by the trial court in the Defamation case filed by Manish Sisodia for August 25, 2021.

The matter was heard by the bench of Justice Indira Banerjee and Justice V Ramasubramanian.

Senior Advocate R Venkataramani appeared for BJP Leaders and Senior Advocate Dr Abhishek Singhvi appeared for Manish Sisodia.

A defamation case was filed by Sisodia against Tiwari, BJP MPs Hans Raj Hans and Pravesh Verma, BJP MLAs Manjinder Singh Sirsa and Vijender Gupta and BJP spokesperson Harish Khurana for making allegations regarding his (Sisodia’s) involvement in Rs 2,000-crore corruption in the construction of classrooms for Delhi government schools.

Sisodia, in the defamation case, stated that all the allegations made by the BJP leaders jointly and severally were false, defamatory and derogatory, and intended to damage his reputation.

On December 17, 2020, the Delhi High Court bench of Justice Anu Malhotra had dismissed the petitions by MP Tiwari and MLA Gupta challenging trial court order issuing summons to them in the defamation case filed by Sisodia. The petitioners had also sought quashing of an order passed by Rouse Avenue Court on November 28, 2019.

Bench of former Chief Justice SA Bobde, Justice AS Bopanna and Justice V Ramasubramanian while issuing notice had stayed the operation of summoning order 28.11.2019 passed by ACMM-I, Rouse Avenue Court Complex, New Delhi and all orders and proceedings emanating from the Complaint Case No. 51/2019 titled as ‘Manish Sisodia v. Manoj Tiwari & Ors.’.

The matter is now expected to be heard on August 25, 2021.
