Supreme Court issues notice in plea seeking to constitute District level Committee to implement RPwD Act, 2016

The plea also seeks enforcement of the right to live with dignity of persons with disabilities.

 

In a plea seeking to constitute district-level committees to enforce and implement the Rights of Persons with Disabilities Act, 2016, the Supreme Court today issued notice to the defaulting states.

The plea filed by one Seema Girija Lal also seeks enforcement of the rights of persons with disabilities to live with dignity. The plea highlights that provisions of the Act of 2016 had not been implemented by States.

The Top Court noted that Lal is a member of a forum for parents, professionals and other stakeholders dealing with the rights of children with disabilities.

When the matter was taken up today, a bench of CJI Chandrachud and Justice Narasimha opined that it was inclined to issue notice.

To this, the counsel appearing on behalf of the petitioner replied saying that there was no need to issue notice to all States.

"Please see that only ten states have special departments, only twelve states have independent directors, four states don't even have Rules...." the Court was further told.

Upon hearing this, CJI Chandrachud remarked that it could ask the concerned Ministry to hold a meeting with the defaulting states.
