Supreme Court Issues Notice, Provides Interim Relief to President's Gallantry Awardee IPS Officer

Synopsis

In the present matter, an inquiry was initiated against Mahesh Gupta, a 1998-batch IPS officer, the then Director General of Police of the state anti-corruption cell and the Chief of Intelligence and Head of Economic Wing.

A Bench of CJI U.U. Lalit, Justices Ravindra Bhat and, J.B. Pardiwala, in an SLP filed by an IPS Officer against an inquiry of 2020, issued notice returnable on 31st October, 2022. And listed the matter for further consideration. The Bench provided an ad interim relief to the petitioner. 

Senior Advocate Mahesh Jethmalani appeared for the petitioner. And submitted that none of the judgments in Kiran Bedi and LK Advani's case have been followed in the present matter. And that it is an act of cowardice on the part of the respondents. 

In the present matter, an inquiry was initiated against Mahesh Gupta, a 1998-batch IPS officer, the then Director General of Police, the Chief of Intelligence and Head of Economic Wing.

The inquiry was against an IPS Officer, who was awarded with President's Gallantry Award in 2009 for Naxalites operation. However, in 2020 an enquiry was initiated against him.
