Supreme Court modifies order granting interim bail to Raghav Magunta, asks him to surrender on June 12

Synopsis

Yesterday, while seeking urgent listing of the appeal challenging the interim bail, the Supreme Court was told that Magunta's regular bail application had been rejected by the trial court, and another bail sought in connection of his wife's health was also rejected.

The Supreme Court today modified the interim bail granted to MP Magunta Srinivasulu’s son Raghav Magunta in the Delhi liquor scam case, asking him to surrender on June 12, 2023. 

Yesterday, a vacation bench had agreed to hear the Enforcement Directorate's (ED) appeal challenging the order granting interim bail to Raghav, after the same was mentioned for urgent listing.

The Delhi High Court on June 7 had granted 15 days interim bail to Magunta, son of YSR Congress Party MP, to take care of his ailing grandmother, who was in the ICU in Nellore.

When the case was taken up today, Additional Solicitor General SV Raju told a bench of Justices Aniruddha Bose and Rajesh Bindal that the 15 day bail was granted incorrectly as the injuries where not that serious.

"This is a case of fraud and injuries are not serious at all.. there is history of tampering..Before High Court it was pointed out that it was paternal grandmother, she is in the ICU for a long period, they are all scamsters, there is a history of tampering. Sufficient time has been given, he has seen his grandmother, now he can come back. These are all tricks, he has not gotten regular bail, that is why he applied for interim bail..on these grounds..when he sought bail saying his wife is sick, medical report was sought, he withdrew it..", the ASG told the vacation bench.

Senior Counsel Amit Desai, appearing on behalf on Magunta told court that it was a matter of two weeks, and bail was granted on humanitarian grounds.

While recording the ED's contention that there were other relatives to look after the ailing lady, the Supreme Court ordered,

"Having considered the respective submissions, and also, on going through the medical documents of the old lady, in our opinion, the purpose for which the respondent has been released on bail, could be served, if he is asked to surrender on June 12, 2023. We accordingly modify the impugned order."

 

Senior Advocate Vikas Pahwa had appeared for Magunta before the Delhi High Court, seeking a 6 week interim bail.

"I am a grandson I can look after my grandmother. My regular bail is listed for consideration on July 26...", Pahwa had told the High Court.

In reply, the ASG had said, "Nowadays, everyone is falling in the bathroom and filing for an interim bail. It has become a series...3 cases in the last one week."

Justice Chandra Dhari Singh had refused to accept the ASG's submission and said, "Mr. Raju if the grandson is interested in taking care of their grandmother..... is a thing in the Indian Society."

Last month, a Delhi court had dismissed Magunta’s interim bail plea, stating that he was being prosecuted for money laundering which was a serious economic offence.
