Supreme Court raises concerns over investors sending WhatsApp messages to Judges seeking redressal [Heera Gold Scam]

The Supreme Court has recently raised concern over the investors/ victims of Heera Gold Scam sending WhatsApp messages to Judges, seeking redressal.

However, Justice SK Kaul said that, "We appreciate their concern but that is not the method for seeking redressal. We therefore call upon them to desist from doing so."

The bench was hearing a plea filed by investigating agency, state of Telangana against Heera Gold Exim Pvt. Ltd. over alleged defrauding of its investors.

Heera Golf Exim Pvt Ltd collected investors money on the promise to pay 36% dividend return, however, the same was not paid. The investors' money was allegedly duped. Earlier, the Court had granted bail to its Managing Director on the ground of settling investors' money.

The bench over the issue of non-availability of FSL report said, "It is difficult to traverse a path where the investigating agency keeps on billing the accused for their investigation. This may create a wrong precedent elsewhere."

Whereas, the bench further noted, "A number of Courts have expressed the views on the inadequacy of the number of FSLs If the complexity of the alleged frauds have gone up so as the technology which should be available both in hardware and software and manpower with the investigating agency to deal with same."

Adv. Ranjit Kumar appearing for the agency suggested that if the facilities of the company are utilized, obtaining the requisite data may become much simpler.

"To say the least, three years has been a long period of time to come to grips with the nature and extant of offences but we are still trying to get some light on it," the bench observed.
