Supreme Court refuses to transfer Union Minister Ajay Mishra's plea in a 22 year old Lakhimpur Kheri Murder Case

Synopsis

The Court was of the opinion, that since the matter is already listed for November 10, 2022, to which both the Senior Counsels have agreed, therefore it does not require an intervention.

A Supreme Court Bench of CJI U.U. Lalit and Justice Bela M Trivedi, has refused to transfer a government appeal from Lucknow to Allahabad, sought through an SLP (criminal), in a murder case where Union Minister Ajay Mishra Teni is an accused. 

The matter pertains to a 2000 murder case, where Prabhat Gupta was allegedly murdered and Ajay Mishra Teni was one of the accused, while the Court had acquitted him in 2004. While seeking a transfer, it was submitted, that the Senior Counsel who has to argue the matter at Lucknow was ordinarily based at Allahabad and because of his old age it would not be possible for him to go all the way to Lucknow for arguments.

Further that the "...appeal was actually heard in the month of March, 2018. However, till April, 2022 no judgment having been delivered, a request was made on behalf of the complainant for rehearing of the appeal, the petition read.

However, the Court was of the opinion that since the matter is already listed for November 10, 2022, to which both the Senior Counsels have agreed, therefore it does not require an intervention. And in case Senior Counsel is not able to come down to Lucknow, a request for appearing  through videoconferencing may be considered by the High Court, Bench further added.
