Top Court agrees to list plea raising issue, Haryana and Madhya Pradesh Judiciary scheduled on same day

The Supreme Court on Thursday agreed to list the plea challenging the notification issued by the Haryana Public Service Commission whereby the Mains Examination of the Haryana Civil Services (Judicial Branch) has been fixed to be conducted on 06.05.2022 to 08.05.2022, the dated 06.05.2022 which is in clash with the dated already fixed by the High Court of Madhya Pradesh for preliminary examination of the Madhya Pradesh Judicial Services.

A bench of Justice Chief Justice of India NV Ramana, Justice Surya Kant and Justice Hima Kohli asked the petitioner whether the court can fix and change dates of examinations.

Counsel appearing for the petitioner had mentioned the matter over the issue that the Harayana Judiciary Examination and Madhya Pradesh Judiciary Examination are going to be conducted on the same day stating that "Thousand of aspirants will be debarred Milords".

The plea stated that the petitioners are likely to be prejudiced and their right to participate in the Madhya Pradesh Judicial Services will be infringed and an irreparable loss and injustice will be caused to the petitioners if the dates of Mains Exam of Haryana Civil Services (Judicial Branch) is not changed and fixed on other dates not clashing with any other judicial exam.

The plea has sought direction to quash the notification and to postpone the Mains Exam of Haryana Civil Services (Judicial Branch) to any other date except 15.05.2022 (date of preliminary examination of Gujarat Judicial Services).

The bench noted that the matter will be listed before another bench next week.
