Top Court grants bail to law intern booked for filming court proceedings

Synopsis

The Supreme Court has been informed by the MP government that the contention of the law student that the advocates who had gone from Delhi to Indore for contesting her bail applications had sought protection from local police was in fact untrue and contrary to the record.

The Supreme Court today granted bail to a law intern accused of recording a video of bail proceedings in another controversial matter, i.e., a bail hearing of a Bajrang Dal member who was arrested for alleged vandalism of the movie Pathaan.

A bench of Justices Ajay Rastogi and Bela M Trivedi was told by Additional Solicitor General KM Nataraj, appearing for the Madhya Pradesh government, that the Court may release the accused on bail.

The 21-year old woman, a law student was arrested in Indore in January this year.

It is alleged that a recovery of Rs. 1,26,110/- was made from the accused law student and a complaint was submitted by one practicing advocate of District Court, Indore, whereby she was alleged of having connection with the Popular Front of India (PFI).

State of MP has submitted before Court that the matter at hand is being treated as a sensitive one since on the one hand, the accused is a young student having no criminal antecedents whatsoever however on the other hand, the allegations against the accused are of severely grave nature.

At the very inception of the matter a SIT was constituted by the concerned DCP for a fair and proper investigation into the allegations, Court has been further told.

Senior Advocate Dushyant Dave appeared for the petitioner. 

"There is a complete breakdown of law and order machinery in the respondent state. State authorities seem to be either infected by communal virus themselves or are under the pressure of communal elements," the petitioner had submitted.

In this backdrop, the state of MP submitted that that there existed no law-and-order situation in the city of Indore as has been contended by the petitioner and as a matter of fact, her bail application was filed and contested by a local lawyer.

The petitioner had prayed that an inquiry be conducted by a High Court judge into the matter, and directions be issued to the Madhya Pradesh government to ensure her safety.

The petitioner also sought a direction to quash the first information report (FIR) against her.

The matter will next be heard on April 12, 2023.
