Extortion Case Against CBCID Head Constable: Allahabad HC Orders ADG-Level Monitoring of Probe

Allahabad High Court directs senior ADG to oversee extortion probe against CBCID head constable

The Allahabad High Court has directed the Uttar Pradesh Director General of Police to ensure independent and senior-level monitoring of criminal investigations against a serving CBCID head constable and another accused, after flagging concerns over the gravity of allegations and the need for a fair probe.

A division bench of Justices Chandra Dhari Singh and Lakshmi Kant Shukla ordered that an Additional Director General of Police (ADG)-rank officer, posted outside the Varanasi range, be nominated to monitor the investigation in the case as well as in two other FIRs pending against the constable and the other accused (the petitioners). The monitoring officer has been directed to file a status report within four weeks.

Court was dealing with a criminal writ petition seeking quashing of an FIR registered on September 6, 2025, at Saidpur police station in Ghazipur district. The FIR was registered under Sections 308(2), 308(5), 316(2), 316(5), 319(2), 318(4), 338, 336(3), 340(2), 339, 229, 3(5), 351(3), 231 and 61(2) B.N.S. It accuses the petitioners forcibly taking 40 blank signed cheques and five blank signed papers from a man and then using them to extort money through repeated cheque dishonour cases.

Noting that one of the accused in the case is a serving head constable with the CBCID, the high court, in October, had vacated interim protection granted to the petitioners.

In its October 8 order, a coordinate bench had recorded that the offences disclosed were “grave enough” to warrant an independent investigation. It had also noted that instructions sought from the State had not been furnished, leading the court to observe prima facie that the petitioner might be exercising influence over the investigating machinery. The bench had consequently summoned the ADG, Varanasi Zone, to personally monitor the probe and disclose the progress through an affidavit.

Pursuant to that direction, the ADG, Varanasi Zone, appeared before the court in the present hearing and filed a personal affidavit. The State, represented by the Additional Advocate General, further informed the court that two other FIRs registered in 2022, one in Varanasi and another in Ghazipur, were also pending against the petitioners and required fair investigation.

The State submitted that while the respective investigating officers could continue probing the cases, the investigations should be monitored by a senior officer of ADG rank, preferably posted outside the districts concerned. This, it was argued, would inspire confidence in the fairness of the process.

Senior counsel appearing for the petitioners opposed the affidavit filed by the ADG and contended that the investigation was not being conducted fairly. It was also pointed out that the petitioners had approached the Supreme Court challenging the earlier October 8 order. At the same time, the petitioners agreed that the investigation in all pending FIRs could be monitored by an ADG-rank officer posted outside the Varanasi range.

After hearing both sides, the bench held that, given the gravity of allegations and the peculiar facts of the case, it was necessary to ensure that all the FIRs were investigated fairly under the supervision of a senior officer. Court accordingly directed the Director General of Police, Uttar Pradesh, to nominate an ADG-rank officer outside the Varanasi range to monitor the investigations and submit a status report within four weeks.

Court posted the matter for further consideration on February 4, 2026, while exempting the personal appearance of the ADG, Varanasi Zone, until further orders.

The petitioners were represented by senior advocate Swetashwa Agarwal, assisted by advocates Mohd. Aman Khan and Krishna Kumar Verma, who contested the fairness of the investigation and sought independent supervision of the probe. The State of Uttar Pradesh was represented by Additional Advocate General Anoop Trivedi, assisted by AGA Paritosh Kumar Malviya, who placed before the court the personal affidavit of the Additional Director General of Police and supported senior-level monitoring of the investigation in the present FIR as well as the other cases pending against the petitioners.
