The Bar Association has called for the strike stating that despite its request before the Chief Justice, arbitrary recommendations have been made, therefore, the strike is necessary to get its members' voices heard.
The Oudh Bar Association today passed a resolution that its member will abstain from work on September 16 and 17 to express their discontent over the recommendation for elevation of persons who are not practicing before the Allahabad High Court as judges.
The notice issued by the Bar Association reads, "This practice lacks objective assessment of an individual and is arbitrary exercise of power....This is a call to save the institution and for the public cause".
As per the notice, a meeting took place today afternoon under the Chairmanship of Association President Rakesh Kumar Chaudhary wherein the decision was taken.
The notice states that the recommendations have been made despite the request made by the Association before the High Court Chief Justice that while recommending the members from the Bar for elevation, only those persons should be considered who are regularly practicing before the High Court ( at Allahabad and Lucknow Benches).
The reason for such demand has been stated as that "such advocates have made contributions in the institution and are primarily practicing before the High Court and are regularly appearing before the members of the Collegium and their objective assessment can be done by the Collegium"
Therefore, stressing that "unfortunately, recently persons who are not practicing before the Court (either at Lucknow or at Allahabad) and do not appear before the judges who are part of Collegium have been recommended for elevation", the Association has called its members to co-operate for the success of the strike.
Recently, the Bar Association President wrote a letter to the Chief Justice of India Justice UU Lalit opposing the request made before the Supreme Court to elevate Advocates practicing at it as High Court Judges.
The letter referred to a recent statement made by Senior Advocate Vikas Singh, who is also the President of Supreme Court Bar Association of India (SCBA), requesting the Top Court to consider the appointment of Supreme Court Advocates for elevation as Judges of the High Courts arguing that Advocates practicing at Supreme Court are more meritorious than Advocates practicing at High Courts.
