Madras HC calls for change in mindset to end caste-based discrimination

The Madurai Bench of the Madras High Court has called for a “change of mindset” in society to ensure that public resources are shared without discrimination, particularly in access to drinking water.

Justice R.N. Manjula, while closing a bail petition filed by one Thirumalaisamy in a criminal appeal, recorded the government’s steps to implement an earlier order of the court directing equal access to public amenities. The case itself related to a plea under the Bharatiya Nagarik Suraksha Sanhita, 2023, and the Code of Criminal Procedure seeking suspension of sentence.

During the hearing, the State informed the court that the Tamil Nadu government had issued a Government Order on August 25, following the court’s July 31 directions, instructing district administrations to act against caste-based discrimination in sharing civic resources. The Principal Secretary has directed Collectors and subordinate officials to make sure that public resources, including water, are accessible to all communities without bias, and to form committees to monitor compliance, court was informed. 

The earlier order also required the provision of sufficient water tap connections across all localities and stressed adherence to Section 21 of the SC/ST (Prevention of Atrocities) Act, 1989, which mandates equitable sharing of water. The Director General of Police has, in turn, circulated instructions to senior officers across the State for enforcement.

While acknowledging the government’s swift action, the judge observed that administrative orders alone would not suffice. “There should be a change of mindset among people to ensure that no discrimination arises between different communities in the sharing of public resources and in the use of public facilities,” the court said.

Justice Manjula suggested replicating a model adopted in Thalaivankottai village in Tenkasi district, where coordinated efforts with youth groups had helped overcome barriers to equal access. “If this model is extended to all districts and panchayat unions, the younger generation will learn to embrace the constitutional value of unity in diversity,” the court observed.

The bench appreciated the measures already taken by the State but urged that the drive continue “with the same spirit, without any dilution or compromise.” With those remarks, the petition was closed.
