Supreme Court Dismisses Plea Seeking Court’s Interference Against West Bengal Chief Minister & Law Minister For Staging Protest At CBI Office

The Supreme Court today refused to entertain a plea by Advocate Viplav Sharma seeking Court's interference against West Bengal Chief Minister Mamata Banerjee & Law Minister Ghatak Moloy for staging protest at the CBI office in Kolkata. 

The matter was heard by a bench of Justice Vineet Saran and Justice Dinesh Maheshwari. 

An appeal was filed against the order dated June 4, 2021 passed by Calcutta High Court bench of Acting Chief Justice Rajesh Bindal and Justice Arijit Banerjee, wherein the Court refused to entertain the public interest litigation filed by Advocate Viplav Sharma seeking reliefs regarding sanction of prosecution and arrest of the accused(s) who are high-profile political leaders in the State of West Bengal.

The High Court while taking note of the fact that the matter was sub judice and was being heard by larger bench consisting five judges where all the accused(s) whose cause was sought to be projected by the petitioner were represented by senior counsels and their arguments in the petition were being heard on a day to day basis. 

Even otherwise the accused, whose cause the petitioner is trying to expouse can very well take care of their rights. They do not belong to a class of society which do not have access to the Court or cannot be represented by lawyers on account of their financial condition,” Court said.
