[Kolkata Mominpur Violence] Calcutta High Court directs formation of SIT to probe the incident

Synopsis

The plea had been filed in view of the violence that erupted in the Mominpur area of Kolkata, West Bengal and it sought a CBI or SIT probe in the matter.

The Calcutta High Court has directed the Director General of Police, West Bengal to form a Special Investigation Team to probe into the Mominpur Violence incident that erupted late at night on October 8.

A vacation bench of Justice Joymalya Bagchi and Justice Apurba Sinha Ray has also directed the West Bengal Government to ensure that no further violence takes place.

The order has been passed in a Public Interest Litigation plea filed by one Nabendu Kumar Bandyopadhyay through Advocate Sukanta Ghosh alleging that the West Bengal Government failed in controling the communal flare-up and rioting in the Mominpur, Ekbalpur area of Kolkata.

The bench, while hearing the matter during the initial hours of the proceedings, directed the State Government to reply as to whether the National Investigation Agency Act has been complied with during the incident and directed them to file a status report by 2:00 PM.

Later, the bench took up the matter at 2:00 PM and directed the State Government to ensure that no violence takes place in the future.

The PIL petition submitted, "The tense situation is also likely to spread to other parts of the city and the State. The police and administration remained mute spectators. The situation looks to further worsen and has gone out of the hands of the administration".

The plea informed the bench that the trouble had erupted on the night of October 8, 2022, over putting up flags in the Mayurbhanj area of Mominpur when Milad-un-Nabi was being observed. Subsequently, such large mobs vandalized, torched, and damaged properties, shops, and homes of people in the area.

It submitted, "that several persons, including Ghulam Asraf, of the Phoenix group, Rehan Khan, son-in-law of the local councilor of the Kolkata Municipal Corporation and one Shahbaz Alam, were involved in the planning and perpetration of violence. It is necessary that the involvement of such people be also properly investigated."
