“Are we the judges or registry?”: Justice Chandrachud lashes out at registry for deleting cases without intimation

Synopsis

Justice Chandrachud, who was prepared to hear a case, was shocked to discover that it had been deleted by the registry without any intimation. 

Justice Chandrachud, judge, Supreme Court of India today lashed out at the registry for deleting a matter without intimating the bench. He said, “Are we the judges or is registry the judge? There is a limit to all this! They should at least tell us before deleting".

A bench of Justices Chandrachud and Bopanna started hearing the matters from its list in the morning, when they reached item 3 in the list, they were informed by the court master that it had been deleted. A visibly upset Justice Chandrachud said, “We read matters and come and the matters are deleted without intimating us!”

Justice Chandrachud expressed that item 3 is a simple matter where the bench was inclined to issue notice, however it has been deleted. The judge thus asked the court master to explain to him by afternoon as to why the matter was deleted without intimation.

It is to be noted that recently, Justice MR Shah also spoke out against the registry on a similar issue. He had said, "Who is the Registrar to decide when a matter is excess or not? it is not the registry’s business and the authority lies with the court! I am the master of what cases I want to hear."

On the other hand, while sitting in the vacation bench, Justice Gavai had asked the counsels to mention matters before the registry and persuade them rather than persuading the bench.
