Complainant moves Supreme Court against SIT report declaring mother accused of sexually abusing minor boy innocent

Synopsis

The plea has contested the findings of an inquiry report in which an SIT led by senior IPS officer Dr. Divya Gopinath investigated a case of alleged sexual abuse of a 13-year-old minor by his 35-year-old mother.

In the Kadakkavoor POCSO case, a plea has been filed in the Supreme Court seeking direction to dismiss the Special Investigation Team's report, which claims that the mother, accused of sexually abusing her 13-year-old minor boy, is innocent. In the plea submitted to the Top Court, the complainant in the case has also asked for the suspension of the mother's release. 

As per the news published by Mathrabhumi.com, the plea has challenged the investigation report wherein, a case of suspected sexual abuse of a 13-year-old minor boy by his 35-year-old mother was investigated by SIT headed by senior IPS officer Dr. Divya Gopinath. The investigating team had already turned in a report that had deemed these accusations to be untrue. Based on this report, the High Court issued the order to dismiss the lawsuit. The Thiruvananthapuram POCSO court thus brought an end to the case's proceedings.

A division bench comprising Justice Surya Kant and Justice Abhay S Oka is set to hear the matter.

It may be noted that an examination by a special team at the Thiruvananthapuram Medical College had also apparently turned up that there is no evidence of wrongdoing. On the basis of the medical examination, the investigative team wrote its report.

A lady accused of assaulting her 13-year-old son at Kadakkavoor was acquitted in a POCSO (Protection of Children from Sexual Offences) court in the city.

Earlier, in view of the delay in the matter, the woman also filed a petition before the High Court of Kerala, which had ordered the POCSO Court to render a decision promptly.
