The Allahabad High Court recently denied bail to a doctor accused of raping a nurse at his hospital, while granting bail to two co-accused.
Dr. Shahnawaj, the owner of AVM Hospital in Moradabad, was accused of sexually assaulting a nurse at the facility, allegedly with the involvement of co-accused Mehnaz and Faizan.
According to the prosecution, the victim was detained overnight and faced casteist slurs along with the alleged sexual assault. The police booked the accused under multiple provisions of the Bharatiya Nyaya Sanhita (BNS), as well as the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. The prosecution further stated that CCTV footage contained incriminating evidence, contradicting the accused's claims of false implication.
Opposing the bail pleas, the prosecution argued that the victim’s delay in lodging the FIR was understandable given the sensitivity of the case. The prosecution dismissed claims that the case was fabricated, stating that there was no apparent motive for false implication.
Having heard the counsel for parties and having perused the record, the bench of Justice Nalin Kumar Srivastava noted that Dr Shahnawaj was the principal offender and there were no compelling reasons to release him at the present stage of the case.
On the other hand, court granted bail to co-accused Mehnaz and Faizan, noting that considering the facts and circumstances of the case and keeping in view the nature of the offence, evidence, complicity of the accused, severity of punishment, they had made out a case for bail. However, their bail was subject to strict conditions, including restrictions on tampering with evidence and intimidating witnesses.
