Allahabad High Court Seeks Govt's Response on PIL for Renaming to 'High Court of Uttar Pradesh'

The Allahabad High Court, Lucknow Bench has sought responses from the central government and the high court administration on a Public Interest Litigation (PIL) seeking the renaming of the Allahabad High Court to the High Court of Uttar Pradesh in all official documents, including rules, judgments, and orders.

The petitioner, Deepanker Kumar, also prayed for proper jurisdiction allocation between the Allahabad High Court and its Lucknow bench.

The division bench comprising Justice Rajan Roy and Justice Om Prakash Shukla ordered the respondent authorities to file a counter affidavit withing four weeks and allowed the petitioner to file a rejoinder within two weeks thereafter and set the matter for a hearing in six weeks.

Court did not deliberate on the issue of maintainability of petition.

The high court order issued on September 11, 2024 reads, "Keeping the question of maintainability of petition and the objection for the reliefs claims in view of a decision of Coordinate Bench in PIL Civil No. 14171 of 2020 open for consideration on the next date and also those objections to be raised at that time, let counter affidavit be filed by the opposite parties within four weeks as in the connected petition vires of Amalgamation Order 1948 is also under challenge".

The PIL, filed through advocate Ashok Pandey, argued that 19 out of 25 high courts in India are named after their respective states, while six are named after the cities where they were established.

The petitioner urged the court to mandate consistent use of "High Court of Uttar Pradesh" across all official documents.

The government and high court administration apprised the court this is the second such petition filed by Pandey, with the first dismissed in 2020.

The earlier petition suggested naming the court either "Prayagraj High Court" or "Uttar Pradesh High Court." However, this detail was not mentioned in the current petition.
