[Delhi Riots 2020] High Court to hear afresh bail pleas of Sharjeel Imam, Khalid Saifi, Gulfisha and Others

Synopsis

The court will hear the appeals afresh as Justice Mridul has been elevated as the Chief Justice of Manipur High Court

The Delhi High Court’s bench of Justice Suresh Kumar Kait and Justice Shailendra Kaur will hear afresh the bail pleas of all the accused in the 2020 Delhi riots case.

Earlier, the special bench of Justice Siddharth Mridul and Justice Rajnish Bhatnagar was dealing with the batch of appeals filed by Sharjeel Imam, Khalid Saifi, Gulfisha Fatima, and seven others.

The court will hear the appeals afresh, as Justice Mridul has been elevated as the Chief Justice of the Manipur High Court.

The court will hear bail pleas filed by accused Sharjeel Imam, Khalid Saifi, Gulfisha Fatima, Meeran Haider, Shadab Ahmed, Athar Khan, Shifa ur Rehman, and Salim Khan. The court will also hear Delhi Police’s appeal seeking cancellation of bail granted to accused Ishrat Jahan.

During the hearing today, Special Public Prosecutor (SPP) Amit Prasad, appearing for Special Cell, Delhi Police, apprised the court that the Justice Mridul-led bench had heard three matters at length and even reserved verdicts in them. "However, they will have to be reheard or argued", the SPP said.

Accordingly, the court listed the matter for hearing as follows:

  • Sharjeel Imam- January 15, 2024
  • Khalid Saifi- January 18, 2024
  • Gulfisha Fatima- January 23, 2024
  • Meeran Haider- January 24, 2024
  • Ishrat Jahan- January 29, 2024
  • Shadab Ahmed- January 30, 2024
  • Athar Khan- January 31, 2024

The court listed the three matters related to the accused Mohd Saleem Khan, Shifa ur Rehman, and Saleem Malik for hearing in February 2024. 

The Delhi Police had registered the case under various offences under the Indian Penal Code, 1860, and the Unlawful Activities (Prevention) Act, 1967. The accused in the case are Tahir Hussain, Umar Khalid, Khalid Saifi, Isharat Jahan, Meeran Haider, Gulfisha Fatima, Shifa-Ur-Rehman, Asif Iqbal Tanha, Shadab Ahmed, Sharjeel Imam, Tasleem Ahmed, Saleem Malik, Mohd. Saleem Khan, Athar Khan, Safoora Zargar, Faizan Khan, and Natasha Narwal.
