Justice Sudhir Kumar Jain of the Delhi High Court recently issued notice to the Central Bureau of Investigation (CBI) on a plea by three retired Indian Air Force (IAF) officers, challenging the trial court’s summoning in connection with the Augusta Westland VVIP Chopper Scam case.
The single-judge bench was hearing a plea filed by three IAF officials namely, Air Commondore Navyath Santosh (Retd.), Air Commodore Sanjay Anand Kunte (Retd.), and Wg Cdr Thomas Mathew (Retd.) challenging the Rouse Avenue Court’s summoning order of July 18 in Augusta Westland scam case.
The Court issued notice to the Central Bureau of Investigation (CBI), Ministry of Defence, and Indian Air Force (IAF), and listed the matter for arguments on January 16, 2023.
The three IAF officers in the plea alleged a lack of sanction for prosecution under Section 197(2) of the CrPC which mandates that no court will take cognizance of an offence unless the Central government has previously sanctioned it.
The plea also stated that the CBI did not disclose any monetary gain or money trail in the charge sheet, which is an absolute requirement for the offences under the Prevention of Corruption Act, 1988.
