On instructions, the counsels appearing for both the accused and the victim submitted that they would each pay a cost of Rs. 2 Lakhs.
The Bombay High Court has imposed a cost of Rs. 2 Lakhs on a rape accused and the victim after determining that the relationship was consensual.
The division bench of the high court comprising Justice AS Gadkari and Justice Neela Gokhale was hearing a petition filed by the accused seeking the quashing of the rape case.
The court was informed that the man had moved into the woman's house, where she was staying with her children. Later, after the relationship became strained, the woman filed an FIR.
She alleged that the man had taken money from her and was unable to pay it back.
She submitted an affidavit before the court stating that she had been in a relationship with the man for four years and that they had now amicably resolved the dispute.
Therefore, the court noted that, "We therefore direct the Petitioner and Respondent No. 2 to pay cost of Rs.2,00,000/- each to the Armed Forces Battle Casualties Welfare Fund within a period of two weeks from the date of uploading of the present Order on the official website of Bombay High Court," the order reads.
