The High Court reserved its order in the bail application filed by the Former Home Minister of Maharashtra Anil Deshmukh, in the Money Laundering case after the Supreme Court directed the High Court to decide the matter expeditiously.
A Single Judge Bench of Justice N J Jamdar of the Bombay High Court reserved its order in the bail application filed by the Former Home Minister of Maharashtra Anil Deshmukh, in the Money Laundering case after the Supreme Court directed the High Court to decide the matter expeditiously
Additional Solicitor General representing ED argued before the court that there was a serious allegation of corruption against the minister. The ASG submitted before the court that Anil Deshmukh was directly and indirectly involved in money laundering, and that he had not complied with the summons issued against him. He further placed certain records before the Court, showing how money was transferred from shell companies from time to time and sent to a Sanstha as a donation. The ASG relied on the statements given by all the witnesses along with statements of Sachin Waze, Parambir Singh, and bar owners from whom money was extorted. ASG also assured the court that necessary medical treatments will be provided by the Jail Authorities to them.
The advocate representing Anil Deshmukh rebutted ASG’s arguments by stating that Anil Deshmukh is 73 years old and is suffering from ailments. He submitted before the court that the entire case is based on statements given by Sachin Waze who is an approver of CBI, and that his character is questionable. He stated that Anil Deshmukh does not have criminal antecedents and that is been a public figure for more than 50 years. He submitted that the present case is to defame, malign, and prosecute the applicant. Further, he also submitted before the court that necessary medical treatment was given to Anil Deshmukh but it does not mean that he can be denied bail if wants to get shoulder surgery done.
Advocate for the applicant during his submissions also stated that "Both the parties know the truth and it is the judge who is on trial"
The court reserved the order after expressing displeasure at the manner in which the applicant had approached Supreme Court after being aware that the matter was assigned by the Chief Justice specifically to Justice N J Jamdar’s court. Justice Jamdar said that the applicant should have mentioned the matter before him in case of urgent relief.
