The division bench noted that the decision of the MCA might affect the case, and therefore, asked the MCA to submit before the court the status of the allegation against the respondent company or any order if passed.
A Division Bench of the Bombay High Court comprising Chief Justice Dipankar Datta and Justice Madhav J Jamdar, on Monday, adjourned a PIL filed by BJP Leader Vishwas Pathak, seeking action against Congress Leader Nitin Raut, for using chartered flights for personal use by misusing his power and position during the pandemic.
The Counsel for the petitioner, informed the court, that a show cause notice was issued by the Ministry of Corporate Affairs (MCA) after a complaint was filed against the company on March 5, 2021.
The Counsel appearing for the noticee i.e., the company from which funds were used, informed the court that a reply was filed with the Ministry of Corporate Affairs, however, there is no further response.
The court directed the MCA to file an affidavit as to the status of the allegations, and if any order is passed by MCA, the same should be placed on record.
The Counsel appearing for Nitin Raut, objected to the locus of the PIL.
The court has kept the matter for November 14, and noted that the PIL will be heard after the order or status of the complaint before the MCA is placed on record.
