Bombay High Court Denies Bail To Man Accused Of Killing His 12 Week Pregnant Wife; Directs Trial Court To Expedite Trial

A single judge bench of the Bombay High Court has denied bail to a man accused of killing his 12-week pregnant wife.

The court was considering a bail application filed by the man who had been charged under Section 302 of the Indian Penal Code for the alleged murder.

The accused was taken into custody by the Karkad City Police Station on September 12, 2018, following the registration of an FIR against him.

The FIR against the man was lodged after the discovery of a body in the room he occupied, accompanied by a foul odour. The applicant contended before the high court that an extrajudicial confession made by the man, though present in the records, was a weak form of evidence.

The defence asserted that even if the prosecution's version was accepted, the incident likely occurred in the heat of the moment at most.

The applicant's legal counsel further contended that the man had confronted his wife with photographic evidence of her involvement with another person, leading to a heated argument.

It was emphasized that considering the incarnation of 4 years 11 months, the applicant should be granted bail.

However, the bench was not convinced and while denying bail to the man directed the trial court to conclude the trial within 6 months.

“In the present facts, I am not inclined to enlarge the applicant on bail, though the applicant is in pre-trial custody almost for the period of 4 years and 11 months. I am inclined to direct the trial Court to expedite the trial with liberty to the applicant to apply after 6 months afresh, if the trial does not conclude by then,” the bench said.
