Bombay High Court Disposes of PIL seeking probe into construction of Pune Metro

Synopsis

The high court said that COEP University should ensure that re-examination should be done with all seriousness.

A division bench of the Bombay High Court comprising Acting Chief Justice SV Gangapurwala and Justice Sandeep V Marne recently disposed of a PIL filed seeking a probe into the quality of the construction of the Pune Metro Rail Project.

Court observed that as per the report of the COEP Technological University, Shivaji Nagar, Pune, an expert faculty to undertake re-examination of the work had been appointed.

"The same shall be done in all seriousness. The copy of the report of expert faculty shall also be provided to the Petitioner," court, therefore, ordered while disposing of the PIL. 

Court stressed that "in matters of public project of this nature, there may not be laxity on the part of any of the stakeholders and the persons manning the project".

The high court was hearing a PIL filed by one Narayan Kochak, a structural engineer, through advocate Nikhil Dongre, seeking a court-monitored probe into the quality of construction and structural safety of the superstructure of metro stations of the Pune metro project.

The plea sought a probe into the quality of the construction, structural safety of the superstructures of the metro stations, and systematic failure of the Quality Assurance / Quality Control system of the Pune Metro Rail Project in Pune.

The petitioner contended that there were gross violations and lapses in the construction of the Metro Stations of Pune Metro on Reach II of Line 2 of the Pune Metro Rail Project which seriously endangered public life and safety of the commuters using the Reach II as well as the passersby and pedestrians traveling below the Metro Stations situated on the Reach II.

The COEP Technological University, Shivaji Nagar, Pune was appointed to look into the issue.

Further, the Maharashtra Metro Rail Corporation Limited wrote to the petitioners that there were some minor deficiencies and they are being attended to.

The counsel appearing for COEP Technological University submitted that it had taken note of the complaint reflected in the local newspapers.

While disposing of the petition the high court said,

“COEP Technological University is required to be more serious in the matter as it concerns the safety of the commuters, passersby and pedestrians".
