Christians Are Being Charged Exorbitant Prices To Secure Burial Place In Cemetery Grounds: Plea In Delhi HC

Synopsis

Advocate Mathew contended that groups referred to as the Grave Mafia, Funeral Service, and Land Mafia had colluded to impose illegal charges, while government authorities continued to ignore complaints regarding these practices.

A petition was filed before the Delhi High Court, alleging that members of Christian communities were being compelled to pay exorbitant fees for securing burial plots in designated cemeteries. The plea requested judicial intervention, asserting that such practices violated fundamental rights and imposed significant financial burdens on affected families, necessitating immediate redressal.

The bench, comprising Chief Justice Manmohan and Justice Manmeet PS Arora, directed Standing Counsel Tripathi to hold discussions with the Chief Secretary of the GNCTD and the Lieutenant Governor to address the issue and submit a detailed response.

Advocate Cheryl Betsy Mathew argued that the government had designated specific burial grounds for Christians in the city to be provided at nominal fees. However, Christians were reportedly charged excessively to secure plots. It was further alleged that plots previously reserved were being resold to bidders offering higher prices. Advocate Mathew also asserted that, in certain cases, old coffins were removed to create space for sale to the highest bidder.

Additionally, Advocate Mathew alleged that since 2016, several structures had been constructed along the cemetery's boundaries, amounting to encroachments. In response to the court’s inquiry, Advocate Mathew clarified that she had made multiple representations to the MCD and DDA, but both agencies failed to provide clarity regarding the jurisdiction of the cemetery. Consequently, she urged the court to oversee an investigation, citing a lack of trust in government institutions, including the DDA and MCD.

After considering the petitioner’s submissions, the court listed the matter for further hearing on November 29, 2024.
