Contempt Plea In Bombay High Court Against CM Eknath Shinde For Awarding Electricity Transmission Contract To Adani

A contempt petition has been filed in the Bombay High Court against the Chief Minister of Maharashtra, Eknath Shinde, for awarding a contract for the transmission of electricity to Adani in the state of Maharashtra.

“The averments made in the Public Interest Litigation No.88 of 2021 may be treated as and part and parcel of this application. Hence, it is most respectfully prayed that this Hon’ble Court may take suo moto cognizance under Courts of Contempt Act and issue notice to Shri Eknath Shinde, the Chief Minister of Government of Maharashtra,” the plea reads.

A contempt petition has been filed in the Aurangabad bench of the Bombay High Court by GTL Mahavitaran Bhrashtachar Virudh Samiti Aurangabad, through Advocate Anand S. Jondhale. 

The petition was mentioned before a division bench of Justice Vibha Kankanwadi and Justice S.G. Chapalgaonkar which posted the matter for hear on 25th October 2024. 

The petition claims that the petitioner had earlier filed a Public Interest Litigation (PIL) concerning a ₹1,500 crore scam involving government authorities, in response to which the high court had issued notice.

The petitioner further states that a civil application was filed on April 27, 2023, after learning that the Maharashtra Government was in the process of awarding a contract for electricity services to Adani Transmission.

The plea argues that the government's act of awarding this contract constitutes contempt of court.

“The Applicant submits that when already a Public Interest Litigation No.88 is pending before this Hon’ble Court and this Hon’ble Court has taken the cognizance of the same and issue a Notice to the Government of Maharashtra, moreover, another civil application is pending for restraining the government in awarding the Contract to Adani Transmission, the Act of the Government of Maharashtra awarding the contract of providing electricity services to the entire State of Maharashtra to Adani Transmission amounts to not only contempt of this Hon’ble Court but fraud on the people of Maharashtra,” the plea states.

The petition seeks to restrain the Maharashtra Government from awarding the contract to Adani Transmission.
