The Bombay High Court recently stated that Dawood Ibrahim is declared a terrorist in his individual capacity and not as an association or gang, and therefore any association with the gang would not attract provisions of stringent laws.

The division bench of the high court, comprising Justice Bharathi Dangre and Justice Manjusha Deshpande, was hearing a bail appeal filed by Faiz Bhiwandiwala and Parvez Vaid.

The duo were arrested by the Anti-Terrorism Squad on the grounds that they possessed 600 grams of ganja and were members of the Dawood Ibrahim Gang.

They were booked for committing terrorist acts and collecting funds for the commission of an offence, as well as under the provisions of the Narcotic Drugs and Psychotropic Substances (NDPS) Act.

The high court while granting bail said that dawood was declared terrorist in individual capacity.

"In our view, prima facie, the offence of Section 20 of the UAPA (being member of a terrorist organisation) would not be attracted, as Dawood Ibrahim Kaskar has been declared as a terrorist in individual capacity. Therefore, any association with him on the pretext that a person belongs to D-gang/Dawood gang will not attract the provisions of Section 20," the court said.
