A defamation suit was filed by BJP Leader Suresh Karamshi Nakhua alleging that Dhruv Rathee, through a provocative and incendiary video, made serious and unsubstantiated allegations against him. It was contended that the video harbored malicious intent by insinuating Nakhua’s involvement in violent and abusive troll activities.
YouTuber Dhruv Rathee, recently, approached the Saket Court in BJP leader Suresh Nakhua’s Defamation Suit alleging that the latter has been concealing facts in the lawsuit. Dhruv Rathee further argued that Nakhua has a history of using abusive language.
District Judge Gunjan Gupta scheduled the matter, for consideration of an interim injunction to refrain Rathee from posting on social media, for August 27.
Advocate Nakul Gandhi, representing Rathee, accused Nakhua of deceit and referred to Nakhua’s history of using offensive language against various public figures, including Sonia Gandhi, Barkha Dutt, and Suhel Seth. Advocate Gandhi contended that Nakhua had intentionally omitted significant visual elements from the video in question, which were essential for assessing the allegations.
Advocate Gandhi notified the court in their reply that Nakhua had concealed these visual elements to mislead the court and sought ex-parte ad interim relief to falsely present an urgency and injury.
Nakhua's post, which Rathee discussed in his video, contained offensive language. Rathee challenged the assertion that referring to Nakhua as an ‘abusive troll’ was defamatory, arguing that such comments were justified given Nakhua's own conduct.
In the previous order, the court had summoned Dhruv Rathee in the defamation suit. The court issued the notice and informed Rathee of Nakhua's request for interim relief. Nakhua argued that Rathee's video aimed to damage his reputation and social standing by spreading false accusations and creating unwarranted connections.
