Delhi Court Acquits 10 Individuals Accused In Gokulpuri Riots Case Due To Lack Of Proof Beyond A Reasonable Doubt

Synopsis

The rioters threatened the complainant and his family to vacate the property immediately. The rioters also stole about 15 tola of gold along with 1/2kg silver and 2 lakh rupees. The rioters allegedly set fire to his furniture, documents, and gas cylinders. 

The Karkardooma Court, on Friday, acquitted 10 individuals accused in a rioting case that occurred in the Gokulpuri area in 2020. Additional Sessions Judge Pulastya Pramachala observed that the evidence produced by the prosecution was insufficient to establish the guilt of the accused individuals beyond ‘a reasonable doubt’. 

The court therefore acquitted the following accused- Mohammed Shahnawaz alias Shanu, Mohd. Shoaib alias Chhutwa, Shahrukh, Rashid alias Raja, Azad, Ashraf Ali, Parvej, Md. Faisal, Rashid alias Monu, and Mohammed Tahir.

Narender Kumar lodged a complaint at the Gokalpuri Police Station alleging that rioters approached his property on February 24, 2020, from the Mustafabad side road. He claimed that approximately 1500 people approached the rented pizza shop on the ground floor of his property and vandalized the shop. He further alleged that about 50-60 people came to the upper floor of his house. 

An FIR was registered under sections 148 (Rioting, armed with deadly weapon), 436 (Mischief by fire or explosive substance with intent to destroy house), 454 (house-breaking in order to commit offence), 452 (House-trespass with for hurt/wrongful restraint), 153A (Promoting enmity between different groups) and 427 (Mischief causing damage).

Police filed a chargesheet on July 14, 2020, a supplementary chargesheet along with a complaint on January 9, 2023, and another supplementary chargesheet on September 25, 2023. The IO informed that the supplementary chargesheet was filed based on the complaint of Rinku. However, the court remarked that the complaint by Rinku could not be clubbed with this case.
