Delhi Court Grants Wrestler Sushil Kumar 7-Day Interim Bail On Medical Grounds

Court was hearing an interim bail plea by Kumar, who has been in judicial custody since June 2, 2021 for alleged killing of junior national wrestling champion Sagar Dhankar.

A Delhi Court on Wednesday granted 7 days interim bail to Olympic medallist Sushil Kumar, accused in case of 27-year-old wrestler Sagar Dhankar's killing at Chhatrasal Stadium in May 2021, on 'medical grounds'. 

Noting that Kumar has a “torn ligament”, Additional Sessions Judge (ASJ) Sushil Kumar of Rohini District Court granted him the relief on furnishing personal bond of Rs. 1 lakh along with two sureties of like amount. The court further directed Kumar to surrender after the surgery on July 30. 

“Keeping in view the present medical condition of the applicant or accused, it is ordered that he be released on interim bail for a period of one week, from July 23 to July 30, only on furnishing personal bond of Rs 1 lakh with two sureties in the like amount”, the ASJ ordered.

"Applicant / accused is directed surrender before the concerned Jail Superintendent after expiry of interim bail period i.e. on 30.07.2023", he said.

The court was hearing an interim bail plea by Kumar, who has been in judicial custody since June 2, 2021 for alleged killing of junior national wrestling champion Sagar Dhankar.

While granting interim bail, the court noted that Kumar has suffered a ligament tear near the right knee (tear of the anteromedial bundle of the Anterior Cruciate Ligament) and the surgery has to be performed on July 26. 

The ASJ noted that the investigating officer (IO) had verified the medical documents and Kumar was advised to be admitted to BLK Max Super Specialist Hospital, Pusa Road on July 23.

“It is further important to mention that medical status report was also called from the office of the jail superintendent concerned and a detailed report has been received which shows that applicant Sushil Kumar was also referred to Sports Injury Centre at Safdarjung Hospital,” the court said.

Further, in view of the threat perception of the witnesses and also considering the safety and security of the accused himself, court ordered that at least two security personnel shall be present with him round the clock to keep vigil over the applicant / accused Sushil Kumar.

"The entire expenditure of deployment of security persons / police men for keeping surveillance and security of applicant / accused shall be borne by the family members of applicant / accused Sushil Kumar and the amount will be deposed as per the norms of concerned Jail Rules Charges and the said amount be deposited with the concerned Jail Superintendent in advance", the court said.

It further directed Kumar not to threaten the prosecution witnesses or tamper with evidence or indulge in any such crime. "In case, it is prima facie brought to the notice of the Court that the applicant/accused is violating the said conditions, the interim bail granted to him shall be liable to be cancelled. The bail application is disposed of accordingly", the court ordered.

Notably, on October 12, ASJ Shivaji Anand had framed charges under Section 302 IPC (Murder) and other offences against Wrestler Sushil Kumar and 17 others in connection with the killing of a 27-year-old wrestler Sagar Dhankar, at Chhatrasal Stadium, in May 2021.

ASJ Anand had also framed charges under IPC Sections 323 (punishment for voluntarily causing hurt), 120-B (punishment for criminal conspiracy), 142 (being a member of an unlawful assembly), 148 (rioting armed with a deadly weapon), and 149 (rioting armed with a deadly weapon) (every member of unlawful assembly guilty of the offence committed in prosecution of common object).
