‘Cannot imagine a father who cannot differentiate between his wife and minor daughter’: Delhi Court Sentences Man To Life Imprisonment

Synopsis

The Court dismissed the arguments of the culpable father for mitigating his sentence, who asserted that his intoxication prevented him from distinguishing between his wife and minor daughter.

In a solemn verdict, a special court in New Delhi sentenced a man to a life imprisonment sentence for raping and impregnating his minor daughter. The court deemed this act as a 'diabolical crime' that warranted no leniency. 

The convict had submitted that he was the sole breadwinner of his family comprising elderly parents, his wife and four children. He also said that being under the influence of alcohol, he could not figure out whether she was her wife or daughter… I am not impressed by the argument of the convict in his mitigation. I cannot imagine a father who cannot differentiate between his wife and minor daughter. Even otherwise, the diabolical act was not committed once but he subjected his own minor daughter to repeated acts of rape and impregnated her”, Additional Sessions Judge Babita Puniya, opined. 

The prosecution meticulously laid out the charges against the man, invoking the stringent provisions of the Protection of Children from Sexual Offences (POCSO) Act, 2012 for aggravated penetrative sexual assault. Additionally, he was also charged under the penal laws for rape, reflecting the severity and gravity of his actions.

During the trial, the court heard harrowing details of the despicable acts perpetrated by the accused, causing immense trauma and suffering to the young victim. The prosecution presented compelling evidence to establish beyond doubt the culpability of the man, leaving no room for ambiguity regarding his guilt.

The court underscored the grave nature of the crimes committed by the man, emphasizing the irreparable harm caused to the minor victim. The court, in its unwavering stance against such atrocities, deemed it necessary to impose the maximum penalty available under the law to ensure justice for the aggrieved party.
