Delhi HC Directs Investigation Into Rape and Blackmail Allegations Against Easy Visa Education Owners

Synopsis

The complainant alleged she was raped and blackmailed at the Easy Visa Education office in October 2021. She visited for help sending her daughter abroad, drank juice provided by Swati Kakkar, lost consciousness, and awoke naked with Amit Kakkar and Shivang Sharma, who recorded the incident and threatened to post the video online.

The Delhi High Court, on Friday, directed an investigation into the rape and blackmail accusations against Amit Kakkar and Shivang Sharma of Easy Visa Education Consultants Pvt. Ltd., Chandigarh. The directions were passed in a petition seeking to annul an FIR filed at the Laxmi Nagar Police Station.

Amit Kakkar allegedly raped her again on December 13, 2021, leading her to file a police complaint. The state's report noted the complainant's lack of cooperation, and Amit Kakkar’s father-in-law lodged a counter-complaint, asserting the allegations were false. The counter-complaint included CCTV footage allegedly showing Amit Kakkar in his office during the incident.

The bench of Justice Jyoti Singh, in its previous order, instructed Stellar Cyber Analytics Pvt. Ltd. to provide a certificate and expert opinion under Section 65B of the Indian Evidence Act, 1872, regarding the DDR hard disk. These materials were sent to the Rohini Forensic Science Laboratory (FSL), with results pending. The court instructed the Director of FSL Rohini to submit the FSL report in a sealed envelope before the next hearing. 

However, during the virtual proceedings, the court noted, “the statement of the prosecutrix…that she does not wish to prosecute the matter, the FIR deserves to be quashed”.
