Delhi HC Directs Sudeva Delhi FC To Serve Notice To Delhi Soccer Association, Lists For Sept 21

The plea alleged that the March 20 elections of the DSA's Executive Committee were held without following the guidelines, instructions, rules, regulations, and procedures prescribed by law.

The Delhi High Court on Monday directed the Sudeva Delhi Football Club (FC) to serve notice to the Delhi Soccer Association (DSA) and others, accordingly, listed the matter for September 21,.

Justice Sanjeev Narula was hearing a petition filed by Sudeva Delhi Football Club (FC), National United Sporting Club, and Golden Start Football Club against the Delhi Soccer Association (DSA), alleging that the March 20 elections of the DSA's Executive Committee were held without following the guidelines, instructions, rules, regulations, and procedure prescribed by law.

The plea stated that the Delhi Soccer Association’s working functioning and operations directly violate the All India Football Federation (AIFF) constitution.

Petitioner clubs claimed that office bearers from the State government were allowed to run in the DSA elections without providing the required no objection certificate from the relevant State government department or Public Sector Undertaking (PSU), as the case may be, which was in direct violation of the Instructions and Office Memorandums issued by the Ministry of Youth Affairs and Sports and the Department of Personnel Training.

The plea also stated that many of the elected members of the Executive Committee are State government employees who have previously served on the Executive Committee for more than two terms or five years, whichever is less, i.e. the maximum time period for which a State government employee could hold on the Delhi Soccer Association's Executive Committee.

It also alleged that the amendment to the DSA statutes was made without proper legal procedure, rendering such an amendment null and void and thus unsustainable in law.

“The amendment's purpose was to allow ineligible candidates (State government employees) to run in the upcoming Executive Committee elections”, the plea stated.

The plea sought directions to set aside the March 20 elections due to a failure to comply with the National Sports Development Code, 2011, the Constitution of the All India Football Federation, and other directives issued by the Department of Personnel and Training of Sports, and others.
