Delhi HC Issues Notice to X Users for Uploading 18-Second Footage of Shazia Ilmi

Synopsis

The case originated from the circulation of a controversial video that showed Ilmi in an unguarded moment after a televised debate. However, during the latest hearing, Ilmi’s counsel informed the court that certain unknown users had re-uploaded the same video despite the earlier takedown.

The Delhi High Court, on Wednesday, issued notices to users of platform X for uploading an 18-second video of Shazia Ilmi in violation of the court’s earlier judgment, which had ordered the removal of the video on the grounds of Ilmi’s right to privacy. The matter was heard by the bench led by Justice Manmeet Pritam Singh Arora.

The counsel appearing for Instagram acknowledged the presence of a single URL associated with the video and expressed no objection to its removal. However, the counsel also pointed out that the date of upload was July 27, 2024 — a date prior to the filing of the case and the delivery of the judgment. Therefore, he suggested that the uploader be given the opportunity to take the content down voluntarily.

The court requested the presence of a representative from platform ‘X’ (formerly Twitter) and instructed the parties to return by 12:30 or 1:00 PM for further proceedings. Subsequently, the court issued a notice to the respondents and directed the concerned platforms to immediately remove the video from all accounts where it had been uploaded.

Additionally, the court directed that if Ilmi became aware of any further uploads of the disputed video, her counsel must notify the respective social media platforms, which would then be required to take down such content without delay.
