Delhi High Court dismisses former West Bengal Chief Secretary's plea challenging transfer of his appeal vs disciplinary proceedings to Delhi

The Delhi High Court bench of Chief Justice DN Patel and Justice Jyoti Singh today dismissed a petition by the former West Bengal Chief Secretary Alapan Bandopadhyay, challenging an order passed of the Central Administrative Tribunal (CAT) transferring a case filed by him from Kolkata to Delhi.

The Division Bench had reserved order on February 25. Dismissing the plea, it said, "...this Court finds no reason to interfere with the aforesaid order. The petition is dismissed. It is made clear that the Court has made no comments on the disciplinary proceedings, including the competence of the Central government to initiate such proceedings."

The Department of Personnel and Training had set up a panel to probe charges against him, levelled as part of disciplinary proceedings initiated for arriving late at a meeting with the Prime Minister to review the cyclone Yaas situation.

This move was challenged by him before the Kolkata Bench of CAT, which matter was transferred to Delhi before any hearing could take place.

Bandopadhyay challenged this transfer order before the Calcutta High Court, which set it aside, however, on appeal by the Centre, the Supreme Court set aside the order of the Calcutta High Court.

Bandopadhyay then moved the Delhi High Court challenging the transfer of the case, stating that the order passed by CAT was in violation of the principles of natural justice, equity and fairness.
