Delhi High Court Dismisses Plea Seeking Rehabilitation Package For Pakistani Migrants

Synopsis

The plea, filed by Akhil Bhartiya Dharma Prasar Samiti sought a rehabilitation package for Pakistani migrants, claiming that these migrants urgently need access to adequate shelter, healthcare, water, electricity and sanitation facilities.  

The Delhi High Court, recently, dismissed a plea filed by Akhil Bhartiya Dharma Prasar Samiti seeking directions against the Central Government to provide a rehabilitation package to migrants from Pakistan who have acquired Indian citizenship under the Citizenship (Amendment) Act (CAA), 2019. 

The bench of Acting Chief Justice Vibhu Bakhru and Justice Tushar Rao Gedela noted that the formulation and extension of such policy was a matter of government policy. The court further observed that the decision about policies lies within the purview of the government. 

The petitioner highlighted that a substantial number of migrants from Pakistan required resettlement measures to ensure a dignified life in India. 

Advocate Divita Dutta, appearing for the petitioner, informed the court that these migrants resided in seven camps across Delhi, including Majnu Ka Tilla, Adarsh Nagar, Signature Bridge, Bhatti Mines, and Rohini. The plea further stated that many of them were living in substandard conditions and urgently needed access to adequate shelter, healthcare, education, water, electricity, and sanitation facilities.

The court noted that the petitioner had already submitted a representation to the authorities requesting such measures. Consequently, the court dismissed the petition, directing the Government to duly consider the representation and arrive at a reasoned decision.
