Delhi HC Restrains Punjabi Rapper Bohemia from Music Production Without Prior Permission of Saga Music

The Delhi High Court has granted an ex-parte ad interim order restricting Punjabi rapper and singer Bohemia (born Roger David), from creating music videos, songs, or engaging in any public performances without prior written permission from Saga Music.

Justice Anish Dayal further prohibited Bohemia or his representatives from making defamatory posts against Saga Music. This order will remain effective until the next hearing scheduled for February 23.

Saga Music initiated legal action against Bohemia, alleging a breach of their contract.

According to Saga Music, Bohemia entered into a talent engagement agreement with them in December 2019, committing to an exclusive 45-month collaboration.The contract explicitly stated that Saga Music would own all intellectual property rights to Bohemia's songs, videos, and performances, and he could not collaborate with other artists or labels without prior written consent from Saga.

The suit claimed that Bohemia violated the agreement by failing to produce any songs for Saga Music while continuing musical tours and releasing collaborative songs on his YouTube channel without consent.

Additionally, Bohemia and his associates allegedly made defamatory statements against Saga Music on social media, leading to disparagement and adverse comments.

After reviewing the case, the single-judge bench concluded that Saga Music had a prima facie case and that an interim order was necessary to prevent irreparable harm to the label.

The court's interim order restrains Bohemia from collaborating with any third-party entity for sound recordings, cinematograph films, musical works, or performances without prior consent from Saga Music.

Notices have been issued to Bohemia and other defendants, and the court has scheduled further consideration of the matter for February 23.
