[Delhi Riots] High Court issues notice on Tahir Hussain's early hearing application in plea seeking stay on FIR

Synopsis

The matter pertains to FIRs registered against Tahir Hussain in connection with the Delhi Riots 2020 case. 

The Delhi High Court on Monday issued notice on an early hearing application filed by former Aam Aadmi Party councillor, Tahir Hussain in a plea seeking stay on one of the two FIRs registered during 2020 Delhi Riots against him on the same issue.

A bench of Justice Dinesh Kumar Sharma said that the bench will not pass any orders without hearing the Public Prosecutor.

The application filed through Advocate Tara Narula stated that the matter will become infructuous if it's not heard.

The Delhi Police has alleged Hussain's involvement in the larger conspiracy that lead to the riots. It has been alleged that Hussain hasd been involved in rioting, mischief by fire and criminal conspiracy.

The Court has now listed the matter for March 3.

It may be noted that recently, during the hearing of his bail application, Senior Advocate Salman Khurshid appearing for Hussain had argued that “Delhi Police have just collected whatever they got and copy-pasted it in different FIRs. Everybody is on bail except the petitioner (Tahir Hussain)”.

He had argued that nobody saw Hussain using any firearms and that all the co-accused were already on bail, even the man who had been alleged of firing was also on bail.

It has been stated that there is no specific act which can be attributed to Hussain.
