"Future cannot be put to jeopardy": Karnataka High Court allows rape accused under POCSO to sit for examination

The Karnataka High Court in a recent decision has allowed a rape accused where the investigation in underway to sit for his examination. 

The single bench of Justice V Srishananda was hearing a bail plea by a 19-year old rape accused under POCSO Act. The accused had approached the Court seeking bail to sit for his upcoming examinations. 

Per contra, the government had contended that investigation is underway and bail would hamper the same. 

The single bench rejected such contention and observed that, 

"Irrespective of the merits of the matter, just because, the case is pending against the petitioner herein... his future cannot be put to jeopardy."

The Court thus permitted the petitioner to sit for the examination at Vivekananda Degree College at Bengaluru where he will be escorted by a police officer. The authorities have also been directed to provide the petitioner with books for studying.
