The Madras High Court today allowed the plea filed by OpIndia Editor-in-Chief Nupur J Sharma and CEO Rahul Roushan to quash the FIR filed against them over a story on Bihari migrants being attacked in the state of Tamil Nadu.
Sharma and Roshan had approached the high court on 24, April 2023 following the Supreme Court's direction. The top court on April 21, 2023, while ordering no coercive action against the two, had asked them to seek the relief of quashing the FIR before the high court.
"We cant' quash but we will protect you. We order that no coercive steps be taken against the petitioner for 4 weeks", the top court had ordered.
The FIR against the two of was registered by the Tiruninravur police, under the Avadi Commissionerate on a complaint by Surya Prakash, an IT member of Dravida Munnetra Kazhagam.
Sections 153A (promoting enmity between different groups on grounds of place of birth, residence, language, etc.), 501 (printing defamatory content) and 505 (making statements conducive to public mischief) of the Indian Penal Code were invoked against Sharma and Roushan.
Initially, the two approached the Supreme Court for getting the FIR quashed. However, while granting interim protection to them, the top court directed them to approach the high court for the relief.
Today, the matter was listed before the bench of Justice G. K. Ilanthuraiyan.
